Unlike secured debt, with unsecured debt, there is no tangible property or collateral to secure the loan or amount owed. There is nothing to repossess in these situations. Unsecured debt, such as credit card debt, is usually discharged under Chapter 7 bankruptcy. If you file for Chapter 13 bankruptcy, you will most likely make payments on your credit card debt for three to five years.
In general, you can discharge credit card debt unless you have taken certain actions, including:
- A large cash advance within 90 days of filing for bankruptcy
- A dramatic increase in purchases on the card shortly before filing
